Terms of Service

1. Acceptance of Terms

By installing, accessing, or using the OpenOcto software and its web administration panel (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must immediately cease using the Service and remove it from your device.

Your continued use of the Service after any modifications to these Terms constitutes acceptance of the updated Terms.

2. Description of Service

OpenOcto is a self-hosted, open-source personal AI assistant constructor with voice control and a persona system. The Service is designed to run locally on user-owned hardware and provides:

  • Voice-controlled interaction with AI language models
  • A web-based administration panel for configuration and monitoring
  • Integration with third-party AI backends (Anthropic Claude, OpenAI, Ollama, and other providers)
  • Text-to-speech and speech-to-text capabilities
  • Configurable AI personas with customizable behavior

The Service acts as an intermediary layer between the user and third-party AI models. OpenOcto does not independently generate AI responses -- all AI-generated content originates from the configured third-party AI backends.

3. License

OpenOcto is distributed under the Business Source License 1.1 (BSL 1.1). You may use the software for personal, non-commercial purposes, including self-hosting for private use, internal organizational use, education, and research. Commercial use requires a separate commercial license from the Licensor.

4. AI-Generated Content Disclaimer

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.

4.1. Nature of AI Responses

The Service facilitates interaction with artificial intelligence language models. All responses generated through the Service are produced by third-party AI systems and are probabilistic in nature -- they may be inaccurate, incomplete, misleading, biased, or entirely fabricated ("hallucinations"). AI-generated content does not represent the views, opinions, or recommendations of OpenOcto, its developers, or the Licensor.

4.2. No Professional Advice

AI-generated responses provided through the Service DO NOT constitute and must not be relied upon as:

  • Medical or health advice. Do not use AI responses to diagnose, treat, prevent, or cure any medical condition. Always consult a qualified healthcare professional. In case of a medical emergency, contact emergency services immediately.
  • Financial, investment, or tax advice. Do not make financial decisions based on AI responses. Always consult a licensed financial advisor, accountant, or tax professional.
  • Legal advice. Do not rely on AI responses for legal decisions or compliance matters. Always consult a qualified attorney.
  • Psychological or mental health counseling. AI responses are not a substitute for professional psychological help. If you are experiencing a mental health crisis, contact a crisis helpline or mental health professional immediately.
  • Safety-critical guidance. Do not rely on AI responses for decisions that may affect physical safety.
  • Professional engineering, architectural, or scientific advice. Do not use AI responses as a basis for professional determinations.
  • Educational authority. AI responses used in educational contexts may contain factual errors and must not be treated as authoritative educational material.

4.3. User Responsibility for AI Content

You acknowledge and agree that:

  • You are solely responsible for evaluating and verifying any AI-generated content before acting upon it.
  • You must exercise your own independent judgment before making any decisions based on AI responses.
  • AI responses may contain errors, outdated information, or content that is inappropriate for your specific circumstances.
  • The Licensor has no control over the content generated by third-party AI models and cannot guarantee its accuracy, completeness, safety, or suitability for any particular purpose.

4.4. Persona Behavior

The AI personas available in the Service (Hestia, Metis, Nestor, Sofia, Argus, Octo, and others) are stylistic configurations that influence the tone and style of AI responses. Personas do not change the fundamental nature of AI-generated content and are subject to all disclaimers in this section. A persona presenting as "caring" or "wise" does not make its responses valid professional advice. A persona configured for children (e.g., Nestor "Wise Mentor") does not guarantee that all AI responses will be appropriate for minors. Parental supervision is required at all times when minors use the Service.

5. Privacy and Data

5.1. Local Processing

OpenOcto is designed with a privacy-first approach. By default, all data -- including voice recordings, conversation history, user configuration, and personal information -- is processed and stored locally on your device.

5.2. Third-Party Data Transmission

When you configure external AI backends (such as Anthropic Claude, OpenAI, or other providers), your text queries and conversation history are transmitted to those providers' servers. This data transmission is:

  • Initiated solely by your configuration choices
  • Governed by the respective privacy policies and terms of the third-party providers
  • Outside the control and responsibility of OpenOcto

You are responsible for reviewing and understanding the privacy policies of any third-party AI provider you configure.

5.3. Voice Data

Voice recordings captured by the Service are processed locally for speech-to-text conversion. Audio data is not stored permanently unless you explicitly configure such behavior. The Licensor does not collect, access, or process your voice data.

5.4. Children's Data

The Service does not knowingly collect personal information from children under the age of 16. All data processing occurs locally on user-owned hardware. However, when third-party AI backends are configured, text queries -- including those made by minors -- are transmitted to those providers. Parents and legal guardians are responsible for reviewing the privacy policies of configured AI providers.

6. User Responsibilities

  • You are solely responsible for securing access to your OpenOcto instance, including the web admin panel, network configuration, and all associated passwords and credentials.
  • You are responsible for safeguarding any API keys and credentials you configure within the Service.
  • You must not use the Service for any unlawful, harmful, abusive, threatening, harassing, defamatory, or otherwise objectionable purpose.
  • You must not use the Service to generate content that violates applicable laws or the terms of service of the configured AI providers.
  • You must not use the Service in any manner that could harm minors.
  • You are responsible for compliance with all applicable local, national, and international laws and regulations.

7. Third-Party Services and Dependencies

7.1. AI Providers

OpenOcto integrates with third-party AI services including, but not limited to, Anthropic Claude, OpenAI, and Ollama-compatible providers. Your use of these services is governed by their respective terms of service and privacy policies. The Licensor is not affiliated with, endorsed by, or responsible for any third-party AI provider.

7.2. Open-Source Components

The Service incorporates open-source components (including but not limited to Piper TTS, Silero TTS, Silero VAD, whisper.cpp, OpenWakeWord) which are subject to their own respective licenses. The Licensor makes no warranties regarding the functionality, accuracy, or safety of these components.

7.3. Availability

The Licensor does not guarantee the availability, uptime, or functionality of any third-party services. Changes to third-party APIs, pricing, or terms may affect the functionality of the Service without notice.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT, SECURITY OR UNINTERRUPTED OPERATION, COMPATIBILITY WITH YOUR HARDWARE OR SOFTWARE, AND FREEDOM FROM ERRORS, BUGS, OR VULNERABILITIES.

THE LICENSOR DOES NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR ANY PURPOSE; THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; THAT THE SERVICE WILL OPERATE WITHOUT INTERRUPTION OR ERROR; THAT ANY DEFECTS WILL BE CORRECTED; THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; THAT VOICE RECOGNITION OR SPEECH SYNTHESIS WILL BE ACCURATE; OR THAT CONTENT FILTERING WILL PREVENT ALL INAPPROPRIATE CONTENT FROM BEING GENERATED.

9. Limitation of Liability

9.1. Exclusion of Damages

IN NO EVENT SHALL THE LICENSOR, ITS FOUNDERS, DEVELOPERS, CONTRIBUTORS, AFFILIATES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES; PERSONAL INJURY OR PROPERTY DAMAGE; EMOTIONAL DISTRESS OR PSYCHOLOGICAL HARM; OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES -- ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2. Specific Exclusions

Without limiting the generality of the above, the Licensor expressly disclaims any liability for:

  • Harm resulting from reliance on AI-generated content, including medical harm, financial losses, legal consequences, property damage, or personal injury
  • Actions taken or not taken based on information provided by AI models through the Service
  • Incorrect, misleading, or harmful AI responses, including AI "hallucinations"
  • Data loss or corruption resulting from use of the Service
  • Security breaches resulting from improper configuration or exposure of the Service to the internet
  • Damages arising from third-party AI provider failures, outages, or policy changes
  • Hardware damage resulting from extended operation of the Service
  • Harm to minors resulting from AI-generated content, regardless of persona or content filtering configuration
  • Educational harm resulting from minors learning or relying on incorrect information provided by AI models

9.3. Maximum Liability

IN JURISDICTIONS THAT DO NOT ALLOW THE COMPLETE EXCLUSION OF LIABILITY, THE LICENSOR'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO THE LICENSOR FOR USE OF THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless the Licensor, its founders, developers, contributors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use or misuse of the Service
  • Your reliance on AI-generated content
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your violation of any third-party rights
  • Content you submit to or generate through the Service
  • Any minor's use of the Service under your supervision or on your devices

11. Age Restrictions and Minors

11.1. Age Requirement

The Service is not intended for independent use by individuals under the age of 16 (or the applicable age of digital consent in your jurisdiction). If you are under 16, you may only use the Service under the direct supervision of a parent or legal guardian who has reviewed and accepted these Terms.

11.2. Parental Responsibility

Parents and legal guardians who allow minors to use the Service acknowledge and agree that:

  • They are solely responsible for supervising the minor's interaction with the Service at all times
  • AI-generated content may not always be age-appropriate despite persona configurations or content filtering settings
  • Features designed for younger audiences (such as "Kids Mode", child-oriented personas, or educational features) are convenience features only and DO NOT guarantee content safety, accuracy, or appropriateness
  • They will not hold the Licensor responsible for any content generated by third-party AI models during the minor's use of the Service
  • They are responsible for configuring appropriate content restrictions on the AI backend level
  • They assume all risk associated with a minor's use of the Service

11.3. No Child Safety Guarantee

The Licensor does not and cannot guarantee that AI-generated content will be safe, appropriate, or suitable for minors under any circumstances. Content filtering and persona configurations are best-effort features that rely on third-party AI model behavior, which is outside the Licensor's control.

11.4. Compliance with Child Protection Laws

The Service is self-hosted software and does not collect personal information from children. However, third-party AI providers configured by the user may have their own policies regarding minors. Users are solely responsible for ensuring compliance with all applicable child protection laws, including but not limited to COPPA (United States), GDPR Article 8 (European Union), Federal Law No. 436-FZ (Russian Federation), and any other applicable legislation.

12. Modifications to the Service and Terms

The Licensor reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, without notice and without liability. The Licensor reserves the right to modify these Terms at any time. Your continued use of the Service after the posting of modified Terms constitutes acceptance of the changes.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Russian Federation, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of Moscow, Russian Federation. For users outside the Russian Federation, disputes may also be resolved in the courts of the user's jurisdiction if required by mandatory provisions of applicable consumer protection law.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such invalidity shall not affect any other provision, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the License and any other legal notices published through the Service, constitute the entire agreement between you and the Licensor regarding your use of the Service.

16. No Waiver

The failure of the Licensor to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
